1. Introduction

These Terms and Conditions (“Terms”) govern your use of the services and products provided by First Down Sport, a business operating in South Australia, ABN 25 956 139 948, located in Adelaide, South Australia 5000. By placing an order or accessing our services, you agree to be bound by these Terms.

2. Products and Services

First Down Sport provides custom-designed sporting apparel, merchandise, branding and accessories for individuals, teams, and organizations. Products are made to order based on specifications provided by the customer.

3. Orders and Payment

3.1 Order Placement

Orders can be placed through our website, via email, or in-person consultation. All designs must be approved in writing before production begins.

3.2 Pricing

All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice.

3.3 Payment Terms

A 50% deposit is required to commence production. The remaining balance must be paid in full before the products are shipped. We accept bank transfer, credit card, and other approved payment methods.

4. Customisation and Approvals

4.1 Design Ownership

Customers must ensure they have the rights to use any logos, images, or designs submitted for customisation. First Down Sport will not be held liable for any copyright or trademark infringements.

4.2 Proofing

Customers will receive a final digital proof for approval. Production will not begin until written approval is received. Once approved, no changes can be made.

5. Production and Delivery

5.1 Production Time

Standard production time is approximately 4–6 weeks from the date of final approval and deposit. Timeframes may vary based on order size, complexity, and material availability.

5.2 Delivery

Shipping is available across Australia. Delivery times may vary and are estimated only. First Down Sport is not liable for delays caused by third-party couriers.

6. Returns and Refunds

6.1 Custom Products

Due to the nature of custom orders, returns and refunds are generally not accepted unless the item is faulty or materially different from the approved proof.

6.2 Faulty Products

If a product is faulty or not as described, please contact us within 7 days of receipt. Faulty items may be repaired, replaced, or refunded in accordance with Australian Consumer Law.

7. Intellectual Property

All design templates, illustrations, and branded material created by First Down Sport remain the intellectual property of First Down Sport unless otherwise agreed in writing.

8. Limitation of Liability

To the fullest extent permitted by law, First Down Sport is not liable for any indirect, incidental, or consequential damages arising from the use of our products or services. Our liability is limited to the replacement or refund of the product in question.

9. Privacy

10. Governing Law

These Terms are governed by the laws of South Australia. Any disputes will be resolved in the courts of South Australia.
